Terms and Agreement

• Payment. The Client agrees to pay WayTutors the agreed-upon package (please see our pricing and plan page for more details). The client must purchase a plan via our pricing & plan tab. The client will never give or make payments to the Tutor. Clients must schedule all tutoring hours within 30 days. All unused tutoring hours will be subject to the WayTutors refund policy.

• Cancellation And Refunds. If the Client cancels a session with less than twenty-four (24) hours’ notice, the Client will be billed for that unless a valid reason is stated.

  • The Client may cancel a prepaid session less than 24 hours before the scheduled time for the following reasons: an emergency or loss of power. The client may then choose to apply this pre-payment to a future session. Pre-payment sessions are valid for up to one (1) year from the payment date.

  • Lessons not attended for any other reason (other than an emergency or loss of power) by the client without giving 24 hours prior notice to the Tutor shall be charged at the total rate.

  • If the Tutor cancels a session for any reason and at any time less than 24 hours before the start of the session, we will apply that payment to a future session that the Tutor and Client agree upon. 

  • NO refunds and make-up sessions for clients who show up late for a session. Lateness is defined as showing up to a session four (4) minutes past the scheduled start time.

  • All cancellations are subject to a non-refundable fee equal to 40% of the total plan cost. All separate fees paid for select plans are non-refundable. 

 

• ​​Location. Online ONLY. No face-to-face meeting. All tutoring will be done via ZOOM Call. Instructor led certification classes will be administered online via pre-recorded video calls. Students can request a free ten (10) minutes one-on-one tutoring session once a week for the duration of the certification plan via Zoom call. This is subject to Tutor resource availability. WayTutors may substitute this tutoring session with email communications with students.

• Obligations of the Client. For one-on-one sessions, the Client will provide information to the Tutor to assess and identify subject areas that the Client require specific tutoring. The Client agrees to provide the materials needed for each tutoring session (i.e., notebook, writing instruments, computer, etc.). The Client agrees that assignments, exercises, or homework are integral to tutoring and undertakes to complete such work thoroughly and promptly.

• No Guarantees or Warranties. The Client understands that WayTutors does not guarantee any specific outcomes due to tutoring. WayTutors will provide a tutor to help the client succeed. Student success outcome is not guaranteed.

• Waiver of Negligence. The Client waives any negligence on the part of WayTutors regarding the hiring or supervision of the Tutor or the Tutor’s actual conduct.

• Limitation of Liability. In the event of litigation, WayTutors’ total liability shall not exceed the amount of money Client paid WayTutor for services rendered.

• Termination. For One-on-one sessions, the tutoring contract may be terminated by either party at any time by giving the other party seven days prior written notice.

• Minors. Where the Client is a legal minor, the Parent/Guardian shall enter into this tutoring contract on behalf of the Client and shall accept and agree to all the terms and conditions contained herein on behalf of the Client.

• Form Submissions (including testimonials): By clicking submit, you give us your explicit consent to use the data provided via forms for marketing purposes.

• Merger Clause. This contract represents the complete agreement between the Client and WayTutors. It can only be modified in writing. The website is not part of the contract. WayTutors reserves the right to cancel or refuse any service to any interested parties at any time before and during this contract.
